The FTC updated its endorsement guidelines in 2023. Most agencies ignore these in devtool campaigns, assuming developer audiences don't care. That's a mistake — both legally and strategically. Here's what's actually required and how to handle it without killing creator authenticity.

// What the FTC Requires

Any creator who receives compensation (cash, free product, revenue share, equity) for mentioning your product must disclose that material connection "clearly and conspicuously." The FTC guidance emphasizes that disclosures must be hard to miss — not buried in descriptions, not in tiny text, not in hashtag soup.

  • YouTube: Disclosure must appear in the video itself (verbally) and in the description above the fold
  • LinkedIn: "#ad" or "#sponsored" must be in the first line, before "see more"
  • Newsletter: Clear statement at the top or in a clearly labeled sponsor section
  • Discord/Slack: A clear statement that the post is sponsored before the content

// The Authenticity Paradox

Here's what most agencies don't tell you: proper disclosure doesn't hurt performance for technical audiences. Developer audiences respect honesty. A creator saying "Influgoo is paying me to cover Engine today, and here's why I said yes and what I actually think after using it for 3 weeks" performs better than an undisclosed post that savvy developers can see through anyway.

In our Engine campaign, Creator A disclosed the sponsorship verbally at 0:45 in the video. The video still maintained an 87% audience retention rate at the 10-minute mark. Disclosure didn't hurt retention.

// The Templates We Use

  • YouTube verbal: "This video is sponsored by [Company]. They asked me to cover [Tool] because it fits [topic I cover]. I've been using it for [X weeks] and here's my honest take..."
  • LinkedIn: "Sponsored post · [Company] asked me to share this because..." followed by genuine opinion
  • Newsletter: A clearly labeled "Sponsor" section with the creator's genuine recommendation

// Compliance in Your Brief

Every creator brief we write includes explicit disclosure requirements, approved disclosure language, and a compliance check before content goes live. We spot-check all posts within 2 hours of publication to confirm disclosure is in place.
